THE FOUNDRY PAISLEY – TERMS & CONDITIONS



(Operated by Elixir Lifestyle Ltd)





1. Membership & Payments



1.1. All memberships are ongoing monthly agreements unless otherwise stated.

1.2. Membership fees are collected via Direct Debit on the agreed date each month.

1.3. It is the member’s responsibility to ensure their Direct Debit remains active. Failed payments may result in suspension of access.

1.4. After any initial 3 month term, memberships continue on a rolling monthly basis at the current membership rate.

1.5. No partial refunds will be issued for non-attendance or unused time.





2. Membership Cancellation



2.1. Memberships may be cancelled with 1 month’s written notice, submitted in person or by email to The Foundry.

2.2. Members must also cancel their Direct Debit with their bank.

2.3. All outstanding fees must be paid before cancellation can be completed.

2.4. No refunds are issued once a membership payment has been collected.

2.5. Immediate cancellations may be granted only in exceptional circumstances at management discretion.





3. Membership Freeze / Pause Policy



3.1. Membership freezes may be granted for medical reasons, pregnancy, long-term travel or injury.

3.2. Minimum freeze period: 1 month. Maximum freeze period: 3 months.

3.3. Evidence (e.g., medical note) may be requested.

3.4. Membership freezes must be arranged in advance, not retrospectively.

3.5. Membership access is paused during freeze periods.





4. Access & Opening Hours



4.1. Membership grants access to The Foundry during the following staffed hours:


  • Mon–Thu: 6am–10pm
  • Fri: 6am–8pm
  • Sat: 7am–6pm
  • Sun: 10am–4pm



4.2. Hours may be amended for holidays, maintenance or events. Notice will be provided where possible.

4.3. Members must exit the building promptly at closing time.





5. Gym Rules & Code of Conduct



5.1. Members must follow all safety guidance, signage, and instructions from staff.

5.2. Appropriate training clothing and footwear must be worn at all times.

5.3. Alcohol, drugs and tobacco products are strictly prohibited.

5.4. Members suspected of being under the influence will be asked to leave immediately and may have their membership terminated.

5.5. Respectful behaviour towards staff and other members is expected at all times. Abuse or harassment will not be tolerated.

5.6. Equipment must be cleaned after use and returned to the correct place.

5.7. Members must not drop weights in a way that causes damage or poses danger.

5.8. The Foundry reserves the right to revoke membership for repeated rule violations.





6. Health, Safety & Personal Responsibility



6.1. Members use the gym, equipment and facilities entirely at their own risk.

6.2. The Foundry (Elixir Lifestyle Ltd) is not liable for:


  • Injuries sustained through use of equipment or when in the gym facility 
  • Accidents arising from failing to follow safety guidance
  • Loss, theft or damage of personal belongings
    6.3. Members must ensure they are medically fit to participate in exercise.
    6.4. Any medical conditions relevant to safe training must be disclosed.
    6.5. If a member feels unwell, they must stop exercising immediately and inform staff if required.






7. Class Bookings & Attendance



7.1. Classes must be booked via the ClubRight app.

7.2. Cancellations must be made in accordance with the class cancellation window.

7.3. Repeated no-shows or late cancellations may result in fees or temporary suspension of booking privileges.

7.4. Class timetables may be updated based on attendance and demand.





8. Personal Training (PT)



8.1. Personal Training services at The Foundry are delivered by self-employed Personal Trainers who operate independently from Elixir Lifestyle Ltd.

8.2. All PT contracts, packages, payments, cancellations and agreements are made directly between the member and the Personal Trainer.

8.3. Personal Training is not included in any membership type.

8.4. The Foundry (Elixir Lifestyle Ltd) does not accept liability for any injuries, illnesses, accidents, or health issues that occur during Personal Training sessions.

8.5. Members participate in PT entirely at their own risk and must ensure they are medically fit to train.

8.6. Any disputes, refunds or issues relating to PT must be addressed directly with the Personal Trainer.





9. Under-16s Policy



9.1. No individuals under 16 may access the gym floor unless attending a designated youth session or accompanied by an experienced adult over the age of 18

9.2. Youth sessions must be supervised by qualified staff only.

9.3. Parents/guardians are responsible for ensuring their child behaves safely and respectfully within the facility.





10. Dog-Friendly Facility



10.1. The Foundry is a dog-friendly gym.

10.2. Members acknowledge that dogs may be present on the premises at any time.

10.3. Members confirm they have no allergies, fears or objections to dogs being on site.

10.4. Aggressive or disruptive dogs may be asked to leave for safety reasons.


Dog-Friendly Policy


The Foundry is a proud dog-friendly facility.

1. Member Acknowledgement


By joining, you accept that dogs may be present in the gym at any time.


2. Owner Responsibilities

  • Dogs must remain under control at all times.
  • Dogs must be friendly, non-aggressive and safe around people and other dogs.
  • Owners must clean up any accidents immediately.
  • Dogs must not block walkways, equipment or create trip hazards.
  • Dogs should not be on equipment or benches.


3. Gym Rights

  • The Foundry may ask any dog to leave if disruptive, aggressive or unsafe.
  • Excessive barking or jumping may lead to temporary restrictions.


We love our gym dogs — but safety always comes first.



11. Photography, Video & Media Use


11.1. Members must not take photos or videos of other members without explicit permission.

11.2. Filming for commercial or promotional purposes requires approval from management.

11.3. The Foundry may capture photos/videos for marketing.

11.4. By signing up as a member, you consent to incidental inclusion in media content unless you opt out in writing.





12. Behaviour & Disciplinary Action



12.1. The Foundry reserves the right to terminate membership immediately if a member:


  • Violates safety rules
  • Abuses staff or members
  • Causes deliberate damage
  • Engages in unsafe or illegal behaviour
    12.2. No refunds will be given for termination based on misconduct.



13. Data Protection (GDPR)



13.1. Member data is collected and stored in accordance with GDPR regulations.

13.2. Data is used for membership administration, health & safety, communication and billing.

13.3. Members may request access to, correction of, or deletion of their data.





14. Legal



14.1. These Terms & Conditions are governed by the laws of Scotland.

14.2. Any legal proceedings will be handled within Scottish courts.

14.3. By activating a membership, the member agrees to all terms set out in this document.


15 Emergency Procedures


In the event of an emergency, please follow the steps below:



15.1 Fire Alarm



  • Stop exercising immediately.
  • Leave all belongings.
  • Follow illuminated exit signs.
  • Evacuate calmly to the designated assembly point outside the building.
  • Do not re-enter until authorised by staff or emergency services.




15.2 Medical Emergencies



  • Notify staff immediately.
  • Do not move injured individuals unless necessary.
  • First aid kits and trained personnel are available on site.




15.3 Equipment or Facility Failures



  • Stop using faulty equipment immediately.
  • Report issues to staff.
  • Do not attempt repairs yourself.



16 Equipment Etiquette Policy 

To maintain a safe, respectful and well-functioning training environment, all members of The Foundry are required to follow the equipment etiquette guidelines below. These rules help protect members, equipment, and the overall gym experience.


16.1 Return & Re-rack Equipment


  • All dumbbells, plates, kettlebells, bars and accessories must be returned to their designated storage areas immediately after use.
  • Plates must be removed from machines and barbells when finished to allow the next member to load safely.
  • Do not leave loaded barbells or equipment unattended.



16.2 Clean Equipment After Use


  • Wipe down benches, pads, handles, barbells, machines and mats using the cleaning products provided.
  • Sweat must be cleaned from all surfaces before you leave the station.
  • Dispose of used wipes or paper towels in the bins provided.


16.3 Share Equipment During Busy Times

  • Be prepared to share benches, racks and machines when the gym is busy.
  • “Working in” (sharing sets) is encouraged, provided it is safe and both parties agree.
  • Use common courtesy — ask before sharing and maintain hygiene by wiping equipment between turns.


16.4 Respect Time Limits

  • Avoid occupying equipment for longer than necessary, particularly during peak hours.
  • Keep rest periods reasonable and avoid sitting on equipment while using your phone.
  • During busy times, a maximum of 10–15 minutes per machine or station may be enforced.


16.5 Use Equipment Safely


  • Check bolts, pins, collars and attachments before use.
  • Report damaged or faulty equipment to staff immediately.
  • Do not attempt to repair or adjust equipment yourself.


16.6Weight Dropping & Noise


  • Dropping weights is only allowed if it is safe to do so and within the appropriate area (e.g., lifting platforms).
  • Avoid dropping dumbbells or barbells in a way that may cause damage or pose a danger to others.
  • Controlled lifting is expected at all times.



16.7 Use Collars on Barbells


  • Collars must be used on all loaded barbells for safety.
  • Do not lift without collars unless performing a specific technique where collars are not recommended (e.g., certain Olympic lifts).


16.8 Keep Walkways Clear


  • Do not leave equipment, bags, water bottles or weights in walkways or around machines.
  • Ensure your training area is kept tidy to prevent trip hazards.


16.9 Use Equipment As Intended


  • Do not modify equipment or use it for exercises it is not designed for.
  • Standing on benches or plates is not permitted unless part of a safe lifting technique.
  • Resistance machines must not be overloaded beyond their designed capacity.


16.10 Consider Other Members


  • Allow others to access weights or equipment even if you are using one item in that area.
  • Avoid excessively loud behaviour or slamming equipment.
  • Treat equipment with care — aggressive misuse damages equipment and reduces availability for others.


Failure to follow equipment etiquette may result in:


  • Verbal warnings
  • Temporary suspension of membership access
  • Termination of membership for repeated or serious breaches



17 Complaints & Feedback Procedure

17.2. How Complaints Are Handled

  • All complaints are acknowledged within 5 working days.
  • We investigate fully and fairly.
  • We may ask for additional information.
  • You will receive a written or verbal response.


17.3. Escalation

If you feel your concern has not been resolved, it will be escalated to senior management.



Lost Property Policy




1. Member Responsibility



The Foundry is not liable for lost, stolen or damaged items.



18. Lost Property Procedure

  • Items found will be stored for 14 days.
  • Valuables (phones, jewellery, wallets) may be handed to management for secure storage.
  • After 14 days, unclaimed items are disposed of or donated.
  • Members must identify and describe items before retrieval.


We recommend not bringing valuables into the gym.




19. Hygiene & Cleanliness Policy

We want to maintain a clean, safe and hygienic training space.

Members must:


  • Wipe down benches, mats and equipment after use.
  • Bring a towel for hygiene and comfort.
  • Use sanitising stations when needed.
  • Avoid attending the gym if unwell.
  • Wear clean gym attire.
  • Dispose of rubbish in bins provided.


The Foundry will:

  • Clean and sanitise the facility daily.
  • Maintain fresh air circulation.
  • Provide cleaning products, wipes and sanitiser.


20. Agreement

By completing a membership sign-up or accessing the facilities, the member confirms they have read, understood and agree to abide by these Terms & Conditions.
